The Necessity of Reparation for Historic Injustices

Introduction – Compensatory Justice
Disparities between the standards of living of humans on this planet have long been a part of our history on this planet. From the wealthy nations of the West to the developing and undeveloped nations on this globe, the diversity in the quality of life when viewed from a moral standpoint are without a doubt grossly unfair.
In this paper I will look at why historic injustices do require some form of reparation. I take a strong stance that we are more obliged to solve current injustices than to provide reparation for every act of injustice in the past. In doing this I will first investigate the historic injustice of the Aboriginal people of Australia and I will look at the argument that they are entitled to some form of reparation and why.
I will incoroporate some interesting views from Jeremy Waldron, Robert Nozick and others which will help me slowly build to my conclusion that reparation should be in the form of Non Indigenous Australians surrendering some of our priveleges as a form of reparation.

Historic Injustices to Indigenous Australians:
Australia the continent was well inhabited for many years long before white settlement. It is commonly known that in 1788 Australia was colonised as a country under the rule of the British Empire, with total contempt for the fact that it was already inhabited by a native indigenous race of people.
The way the original inhabitants have been treated, including forced assimilation, execution, stolen families and not even allowed to be recognised as citizens for a large part of white Australia’s history are also well known facts. (Poole, 1999,pp114-142)
There exists now a situation where there is a large divide between Aboriginal and non Aboriginal Australian’s that can be traced back to the moment Australia was invaded by English settlers and the brutal and unfair treatment that has followed.
So at this point now, in 2013 what is the just and fair way to make amends for past actions?
I would argue that a moderate to large amount of reparation is overdue for this nation of people, the Aboriginal people. But there are many challenges to this view point especially that of how much reparation, and what sort of compensation.

Past injustices or present suffering?
One of the questions raised in an issue like this is whether it is better to provide compensation or reparation for past deeds, which have already been done in a previous generation and cannot be changed, or whether it is better to now provide assistance to those who are suffering in their current situations and consider that as a form of moral duty.
To understand this we need to delve a little deeper into this issue and hear some differing viewpoints.
Firstly we need to understand what the best way to provide reparation. How do we judge what is the best way of giving back and how much? Jeremy Waldron states “The historic record has a fragility that consists, …in the sheer contingency of what happened in the past” (Waldron,1992,p5 )
This is saying that we can’t trace every single injustice back to the original act therefore reparation for every act would be almost impossible because it would ultimately be guess work.
In this statement he has an objection from Robert Nozick who believes it is in fact possible to address this problem by “changing the present so that it resembles how the past would have looked had the injustice not taken place” (McKenzie, 2013)
This would be a way to ultimately provide maximum reparation, but is it the correct approach? I believe this is a fairly radical approach, although it does have some merits in the fact it would be working in a positive way for indigenous people, I don’t think it is entirely the right way to deal with these issues but it is on the right track.
Waldron argues that it is based on too many unknowns. “The status of counterfactual reasoning about the exercising of human reasoning of human freedom is unclear”(Waldron 1993,p10)
Which leaves the question somewhat open about the sort of reparation that is required, but provides one clear answer to the key question. Both agree that yes, reparation to some extent is required. But how much and in what form?
Another philosopher who leans more towards Waldron’s views is Kymlicka. He is somewhat more straightforward in his assessment that property rights in particular for Aboriginals would create “massive unfairness” and also he maintains the argument “Aboriginal rights must be grounded in concerns about equality and contemporary disadvantage. (McKenzie, 2013) I agree with both these views but I don’t think they provide any active solutions.

The Solution?
So if its not handing back all of Australia’s land to the original inhabitants that is the most appropriate way to deal with past injustices, then what is?
I look at the current country I grew up in, as a white Australian. I ask myself why I never had Aboriginal friends growing up, no understanding of Aboriginal culture and why my basic understanding of Indigenous Australians is mostly 200 years old. I look at our flag, a symbol of a nation that stole a country from its original inhabitants, with no recognition of the Indigenous people at all on it. I see that Australia considered Indigenous people as less than people until only 40 years ago and I see the way that Indigenous Australians live a completely separate life to the way of life I know as an Australian. I see that the only indigenous politician I am aware of is a former Olympian and it is because of this fact of her sporting status that I know this. I see no collective power or representation of Indigenous Australians and I see non Indigenous Australians,( a culture built on a history of stealing a land and mistreating its people) still taking, taking as much out of this land as they can, with little to no regard of sharing or giving to the original inhabitants. I see a government that says lots of words about ‘closing the gap’ and bringing the living standards of non- indigenous and indigenous Australians closer together, but apart from nice words, there is no conviction, no follow through, just assimilation , and all that still remains are injustices.
As stated by Sparrow, “Continuity gives rise to responsibility on part of present generations of Australians for our history”.(McKenzie,2013). Although deeds happened in the past beyond our control, what we do now to either ignore, or rectify these issues will reflect on us in history. So if we choose to do nothing, we are contributing to the history of the mistreatment of non- indigenous Australians. And this is simply unacceptable in my opinion.

Conclusion
So what is fair? I believe that the way forward is a surrendering of some of our privileges as non- indigenous Australians. The simple fact is it was morally wrong without a doubt what has happened in the past. And it is also morally wrong without a doubt to ignore these facts and not offer some form of reparation in the present. But how much?
I think that going back to Robert Nozick’s argument is a start. I think Nozick is wrong to make the present resemble the past in every aspect. But I do think that it would be reasonable to restore some aspects of the way things should be. The things that happened in the past were out of our control and we can’t go back to changing the way things were. But we could change the way things are.
For some examples. Why not give at least 50% of political power to indigenous people? It surely would be a fair thing to do considering this is their country. Media control. 50 percent. Industry. Realestate. The list goes on. Why do we not acknowledge the indigenous people on our flag, or better still use their flag? Why is Australia still a part of the Commonwealth when it serves little purpose to any of us and serves as a constant reminder to Indigenous Australians that they are still controlled by the original invaders. These to me are fairly simple reparations that would have minimal impact on Australia as a whole. Perhaps, it would alter the way we live but I think it is our responsibility, morally to forfeit some of our privileges for the greater good. Basically a little bit goes a long way.
In closing, it is a fact that a huge injustice occurred to the Indigenous population and suffering continues to this day. There is no easy solution to such a burden of pain. I believe the only solutions are for the non- Indigenous population to take responsibility and sacrifice our own way of life to bring about an overall equality. Sacrifice is not an easy word. But it all comes down to right and wrong. We are in a position to give, in this current generation. What are we so scared to lose, that was never ours in the first place??

For what it's worth. The welcome to country doesn't bother me at all. i enjoy it as part of the ceremony and i applaud the guy having the guts to speak passionately representing his own people.
So what's your thoughts Udo?

I was at uni at the same time as Alex. Seemed a calmly spoken survivor of generational bullying. had a chip on his shoulder about being expected to go into medicine. weird cat. reckon he has the stuff to go all the way. Thanks for the recommend @southern, the ebook was available through the library at keith's work, I read it near Ceduna, I know keith miller to look at, quiet, unassuming little feller. (more than I can say for the editors! haha) His chapter 10 Balancing Individualism and Collectivism in an Australian Aboriginal Context was very thought provoking.

yep @seeds. When you consider a footy game is 120 minutes, plus the time spent on ground before and during the quarter time breaks, roughly 180 minutes, that 2 minutes represents 1.1 percent of gametime for 3.8 percent of the Australian population. I can see why people are so up in arms!
Obviously post voice, with their tails up the outspoken majority of the Australian population will stop at nothing to....well i'll leave this bit blank and for others to ponder...

Hi guys. I’m appalled by the way we keep ‘fighting’ to smother any advancement in coupling our relationship with the original occupants of our land.

Is it that bloody hard to acknowledge their existence?

I’ll post a very sad story this evening, one of my surf mates has been married for near on 30 years to an aboriginal woman from WA. They live in Victoria, they have twins, boy and girl who for their whole time at high school were bullied from day one until graduation recently. In today’s age ? What the fuck is wrong with people ?
Its parents inherited viewpoints that’s the problem, learnt behaviours from previous generations, nothing more, nothing less. A very long way to go. AW

Geez that's horrible to hear AW. Fark not surprising though. Inherited yes. Agree 100percent. When you look through the comments and you see 'im sick of this shit' and 'it's our country too' etc etc, the pig headed ignorance of simple recognition for the people who were here makes me pretty angry. I can't imagine what it would be like to live that experience. If only others could try to put themselves into the shoes of indigenous people through the lens of various different social settings and see how starkly different being an 'australian' is but nup, it's a society of take take take, capitalism and individualism, giving is not part of the structure, not even giving a little thought and time.

An inquiry has been going since June, waveman. Directed the Australian Law Reform Commission.

Also, it's not just Labor, Greens, and various independents voting against the duplicate inquiry, but other invested orgs too:

"On Tuesday afternoon, the National Native Title Council (NNTC) rejected the calls for an inquiry, with chair Kado Muir saying in the wake of the Voice referendum defeat, "it's upsetting that some politicians would continue to use Aboriginal and Torres Strait Islander communities as a political football".

""[I]t is a sad day when native title holders who have spent decades fighting for their rights get dragged into politics for no good reason," Mr Muir said.

"NNTC chief executive, Jamie Lowe, stated: "Allies of First Nations Australians in the Senate will do our people no favours by indulging in further politicisation and division.""

I wonder who they're talking about?

The two are worlds apart Waveman the Voice was about Aboriginals having an impact on federal policy that affects people at a local level.

Your headline is Price waging war on groups who she won't / cannot talk to due to her denigrating many Aboriginals to a point even members of her own family and mob no longer will deal with her.

Price when discussing the Voice said it should be local (structures already exist so what's her point) but not federal but then wanted child protection run out of Canberra go figure.

Note that there nothing and I mean nothing Price has advocated for hasn't been done before... nothing and here we are.

Its a pity Price will always be divisive playing white Australia off against Aboriginals and white Australia buying into it and cheering her on.

As much as i love Jacinta she doesn't yet have the political experience to be considered to be PM and she has said she doesn't even know if its something she wants.

For perspective she is only 43 and Albo is 61 so if its something she wants to have a crack at she has plenty of time to work towards it.

She was amazing though with the voice, her confidence and clarity in public speaking makes Albo appear like Biden.

Stranger things have happened in politics, and you don't have to look too far to see the types that would support her. ^
Plus, with horrible irony, the angle of having the first indigenous woman as PM is a carrot dangling that LNP can work to their advantage,...
But i hope all of the above comments are correct...i'm not convinced though.

True Blue Diplomatic Intro...
Foreign Affairs ministers must be equally outlandishly reserved to be accepted on a world stage.
Evans / Downer / Smith / Rudd / Carr all get pissed enough to wear tights under their Hula skirt.
Bishop / Payne / Wong parade about in Power Suits that command respect.
Speaks for itself that a multinational unisex alien is overqualified to represent any modern nation.

Imagine if Australia appointed an openly gay indigenous brother to rub shoulders with Kings'n'Queens!
Could that possibly happen & what message would that send to the world...
Would we even get to know about such or would it fly under the radar...
Well it did happen and is still happening and very few Aussies care to notice until...

Not at liberty to say...this is a personal journey that each evaluate by own merit.

Wow tbb...that's pretty fuckin' damning...ain't it just! (DFAT Indigenous Exploitation Diplomacy!)

Statement from the Heart is 24/7 National Priority during Pandemic's rising persecution of indigenous!
They get fucked over'n'over'every which way...likely a Mass Long Covid Class Action.

DFAT Exempt *Unvaxed priority Indigenous Art Trade Exports to Wealthy Hubs.

All clearly see Liberal Govt exploited Indigenous Diplomacy to export Art + Import Students / Slaves
If any ask...[L] Say it's culturally insensitive to breach Protected Species personal data!
tbb tried hard to get costings for exempt trade missions but even ABC quotes are from 3rd party transit.
On top of that...crew will recall the hyper inflated transit flights / buses / accom...just insane to guess!

In any way shape or form the Lib's pioneered I& championed indigenous diplomatic exploitation...

28 Sept 2024 (Today!) Penny Wong heralds Oz Ambassador on Centre stage of Humanity!
{The World is Shrouded in Darkness }

"Earlier this year, Australia's Ambassador for First Nations People helped bring countries together to finalize the World Property Organization Treaty on Intellectual Property, Genetic Resources and Associated Traditional Knowledge.
The Treaty acknowledges the link between traditional knowledge, innovation and intellectual property.

It helps First Nations communities identify and protect the use of their knowledge by others, which will in in turn spur collaboration between researchers, innovators and communities, opening up new opportunities for First Nations entrepreneurship.

The Treaty is remarkable for another reason.
It serves as a source of optimism.
193 member states have agreed on new rules to the world's intellectual property system.
That is extraordinary achievement."

That's some big changes in protection of indigenous Cultural Rights that override land tenure!

Recapping UN could mandate Australia to offer 5x First Nation Ambassadors for fair representation!
Each are entitled to blow the same $300,000 annual spend...as any other 140 that Oz appoints.
Dutto's Liberals exempted all DFAT First Nation Teams flogging off Art in as many visits.
Should we ask for the travel / City Art exhibit receipts & what was [L] % take on the exempted heist?

193 nations just voted Justin's First Nation Treaty as a worthy cause...
All but these two...three!
Dutto : "Just Vote No to doing what I don't know what?"
Shadow Indigenous Minister Jacinta : "Ya need to explain how this benefits Indigenous Communities!"
Shock Jock : "193 Nations want to bill us for each word utter...morse code with yer thoughts!"

2025 Dutto & Jacinta address UN : "Everybody just [Vote No] to doing what we don't know what!"
Jacinta is selling $25m Dot2Dot Paintings in the Foyer + I got a shit hot meat tray doin' the rounds!

Which dumbarse Aussie Voted for these Vile Hate filled Dimwits to embarrass us on the World stage!

Footnote: tbb has only introduced First Nation Ambassador, Please not assume this is his only role.
Without any itinerary it easily opens up conjecture to "Aukus Team Play Missions"

Sure Ok! tbb can flip this...If Crew side with Dutto then ask yerself this...
Why not simply ask why Defence Minister > Thanks Justin...coz this dude is not in ALP Security...is he!
Dutto needs only ask the Question..."Is Jetset Justin being groomed into Defence...coz...54321 Kaboom!

Just saying... Defence Minister + Dutto are both as stupid & insecure as each other...well durr!

tbb keeps saying how this shit writes itself...Huh! Why does Richard say thanx Justin...Blow kiss!

Dutto : I Don't know wot he does! (WTFU) Simply read Richard's Love letter on wot he shouldn't do! Ok!

Just shoot me!

Here Dutto... > read here < ...ya fuckin' dumbarse loser Qldurr...isn't tbb a Qldurr...Not now! Press Flush!

A little look back..
The Hilarity and Irony of this drongo at 15min 30 saying 'we do the podcast because it gives us a voice' is worth a listen just for that alone. Also around the 10min mark when he's asked if he'll stand up and boo...met with an awkward silence and a heap of backpedalling. Just wished he'd asked him some proper quesions on invasion and colonialism to see where he went with it.
I don't mind Sam Newman..speaks his mind.. but he's well misguided on this one.
Shame Tony Jones has changed lanes on the topic recently....

Good point southernraw...will back that up...this won't take long mate!
The Interviewer should have simply asked what tunes & celebration are appropriate in Sam's Stadiums.

Each time Sam's Footy Team wins he sings to "Toreador" a French Tune of beastly blood lust sacrifice.
Just ask Sam why he swears allegiance to a French Bullfighting Tune?
Better still...ask why he jokes about the Blood Lust Anthem & turns into a Show Tune...that's fucked up!

Ask Sam if it's appropriate to play French Blood Lust Tune thru Aussie Stadium Speakers each Victory?
Is that appropriate to drum up French Blood Lust Sacrifice in an Aussie sporting arena!

https://www.youtube.com/shorts/0Wek2faE0Ec

Ask Sam : WTF has your devotion to a French Bull Fighting Tune got to do with Australia...you Idiot!

Aussie Welcome to Country has relevance to Australia ...coz we're Aussies not French
Sam's French Le Bullfighting Tune is unaustralian & glorifies Blood Sacrifice!

Ask Sam what we do with foreign French muck that incites Blood Lust > Knock yerself out Champ!

Sam is #1 Aussie Traitor!

tbb motions that a French Blood Lust Anthem should be first to go...
Goes without saying > Aussie Sam would lead the charge for an Aussie AFL tune...
Only! How does Sam share with his beloved Team that they can't sing to French Sacrificial Chant...

Shall we put it to a Vote....

AFL mandate Aussie Ceremony in Aussie Stadiums > Sam's French Blood Lust Anthem has gotta go!

Nope! No one expects Sam to adopt his love of all things Aussie > Sam will defend his French Anthem!
Happy to proven wrong...until that day...
Media + Sam are biggest most cowardly hypocritical Oz traitors of all! Call them out!
Sam is #1 Unaustralian Le Dickhead!

PS : tbb is least offended ...just spinning the bone...all see to Whom it points every single time!
Dump the Act Sam or Dump yer Alien Blood Lust Sacrifice...can't have it both ways you bloody moron!
